Abstract

El expediente N.º 19428-2018-0-1801-JR-LA-84, iniciado por José Luis Morales Oliva contra la Municipalidad Distrital de La Victoria, donde el demandante solicita que se determine de forma transparente la existencia de un vínculo de índole laboral desde los años 2015 y 2018, donde realizaba funciones que corresponde a un sereno municipal. Así mismo identificar si el despido realizado por parte de la parte demandada fue de forma arbitraria. Además, se analizó los contratos de locación de servicio y CAS emitiros por la entidad corresponden a una relación laboral. El ende jurisdiccional encargado, examinó los medios probatorios como los documentos internos de la municipalidad, constancias de trabajo, recibos por honorarios, entre otros; además de la aplicación de principios de primacía de la realidad y el análisis del artículo 23.2 de la Nueva Ley de Trabajo. La Corte superior de Justicia de Lima concluyó afirmando que si existe una vinculación laboral entre ambas partes sin plazo determinado como lo establece el régimen del D.L. N° 728 y la Ley Orgánica Municipal N° 27972. Así mismo la Sala Superior y la Corte Suprema acordaron la reincorporación inmediata del trabajador a sus labores y el reconocimiento de sus beneficios correspondientes.

The Superior Court of Justice of Lima concluded by stating that if there is an employment relationship between both parties without a specific period as established by the D.L. No. 728 and the Municipal Organic Law No. 27972. Likewise, the Superior Chamber and the Supreme Court agreed on the immediate reinstatement of the worker to his work and the recognition of his corresponding benefits.
