La regulación jurídica de la maternidad subrogada en la Ley General de Salud frente al derecho de familia de mujeres infértiles, Lima 2024

Abstract

Introducción, en la coyuntura actual dentro del marco legal en el procedimiento de reproducción asistida la normativa peruana no contempla su regulación, pero tampoco la limita, generando un vacío legal que dejan en desprotección a las mujeres infértiles. El objetivo: Analizar cómo influirá la regulación jurídica de la maternidad subrogada en la Ley General de Salud frente al derecho de familia en mujeres infértiles, Lima 2024. La metodología para este estudio es de un enfoque cualitativo, método inductivo, tipo básico, diseño no experimental y teoría fundamentada, nivel descriptivo, técnica seleccionada la entrevista y como instrumento la guía de entrevista. El resultado indicó que las técnicas de maternidad subrogada vulneran el derecho de la mujer de ser madre y el de los menores a conocer su identidad u orígenes. En conclusión, se analizó cómo influirá la regulación jurídica de la maternidad subrogada en la Ley General de Salud frente al derecho de familia en mujeres infértiles, lo más importante fue profundizar en el tratamiento legal de estos casos en otros países en donde se ha regulado. Lo que más contribuyó en este estudio fue el indagar en las distintas fuentes del tema propuesto. Lo más difícil fue obtener información de casos frecuentes en el país e internacionalmente por su complejidad, siendo necesario que se pueda contar con un registro y banco de datos de los donantes de células reproductivas, estableciendo su regulación jurídica en nuestro ordenamiento jurídico, teniendo en cuenta los desafíos legales pertinentes.

Introduction, in the current situation within the legal framework in the assisted reproduction procedure, Peruvian regulations do not contemplate its regulation, but neither does it limit it, generating a legal vacuum that leaves infertile women unprotected. The objective: Analyze how the legal regulation of surrogacy in the General Health Law will influence family law in infertile women, Lima 2024. The methodology for this study is a qualitative approach, inductive method, basic type, non-specific design. experimental and grounded theory, descriptive level, interview technique and interview guide instrument. The result indicated that surrogacy techniques violate the woman's right to be a mother and the right of minors to know their identity or origins. In conclusion, it was analyzed how the legal regulation of surrogacy in the General Health Law will influence family law in infertile women. The most important thing was to delve into the legal treatment of these cases in other countries where it has been regulated. What contributed most to this study was investigating the different sources of the proposed topic. The most difficult thing was to obtain information on frequent cases in the country and internationally due to their complexity, being necessary to have a registry and data bank of reproductive cell donors, establishing their legal regulation in our legal system, taking into account relevant legal challenges.
